1. Terms of Service
These terms govern your access to and use of FAIGEN and its associated features, tools and services. FAIGEN is operated by sCloud Pro Ltd ("we", "us" or "our").
By accessing or using FAIGEN, you agree to these terms. If you do not agree, you should not use the service.
These terms apply alongside any additional terms presented for a particular feature, subscription or promotion. If additional terms conflict with these terms, the feature-specific terms will govern that feature to the extent of the conflict.
2. Eligibility & accounts
- You must provide accurate information when creating or maintaining an account.
- You are responsible for protecting your sign-in credentials and for activity carried out through your account, subject to applicable law.
- You must promptly notify us if you believe your account has been accessed without permission.
- You must meet the applicable legal age requirements to use FAIGEN independently. If you are under 18, use the service only where legally permitted and with any required parent or guardian involvement.
- You must not impersonate another person or misrepresent your identity.
We may take reasonable steps to protect accounts, investigate suspected abuse and enforce these terms.
3. Acceptable use
You agree not to use FAIGEN to:
- Break the law, infringe intellectual property rights or violate another person's privacy.
- Create or distribute unlawful, fraudulent, exploitative or deceptive material.
- Attempt to gain unauthorised access to accounts, systems, networks or data.
- Introduce malware, disrupt the service or interfere with its security and operation.
- Abuse, bypass or deliberately circumvent applicable usage limits or security controls.
- Use generated content to impersonate people, mislead others or cause harm unlawfully.
You must have the necessary rights and permissions for the text, images, files and other material you submit. We may restrict access to activity that reasonably appears to violate these terms or applicable law.
4. AI tools & generated content
FAIGEN provides AI-powered capabilities that may include image generation, coding assistance, project creation, file processing and automated workflows. Available features may change over time.
Your inputs and outputs
You retain any rights you hold in material you submit. As between you and us, and subject to applicable law and third-party rights, you may use the outputs generated for you. AI output may not be unique, accurate or eligible for intellectual property protection.
You are responsible for reviewing outputs before relying on, publishing, distributing or using them commercially. Do not assume generated code is secure, generated information is accurate or generated images depict real events or people.
AI limitations
AI systems can produce errors, unexpected results or content that resembles existing material. FAIGEN output should not replace professional advice where qualified advice is needed.
Uploaded material
Do not upload confidential, sensitive or personal information unless you are authorised to do so and understand how the relevant feature processes that material.
5. Availability & subscriptions
We aim to provide a useful and reliable service, but uninterrupted availability is not guaranteed. Maintenance, technical issues, capacity limits, security measures or circumstances beyond our reasonable control may affect access.
Features, usage allowances, trial eligibility and subscription arrangements may vary by plan. Any applicable price, billing frequency, renewal arrangement, trial duration and cancellation conditions will be shown in the relevant offer or checkout before you commit.
Where a free trial or promotional offer is available, its specific conditions will apply. Do not assume a trial is available indefinitely or that it converts to a paid plan unless the offer clearly explains this.
Nothing in these terms removes cancellation, refund or other rights that cannot lawfully be excluded.
6. Suspension, termination & liability
You may stop using FAIGEN at any time. Account closure and the handling of associated data may be subject to applicable procedures and legal obligations.
We may suspend, restrict or terminate access where reasonably necessary for security, suspected unlawful activity, serious violations of these terms, legal compliance or protection of the service and its users.
To the extent permitted by law, FAIGEN is provided on an as-available basis. We do not guarantee that every AI output will be accurate, suitable for a particular purpose or free from errors.
Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited by law, including applicable liability for fraud or fraudulent misrepresentation. Your statutory consumer rights remain unaffected.
Where permitted by law, we are not responsible for indirect or consequential losses arising from use of the service. Any other limitation of liability must be interpreted consistently with applicable law.
7. Privacy Policy
This policy explains how sCloud Pro Ltd handles personal information in connection with FAIGEN. Where we determine why and how personal data is processed, we act as the data controller for that processing.
Our processing is subject to applicable data protection law, including the UK GDPR and Data Protection Act 2018 where applicable.
The information actually processed depends on the features you use, your account configuration and the technical systems supporting the service.
8. Information we process
Account information
This may include your name, username, email address, account identifier, authentication information and account preferences.
Prompts, uploads and outputs
When you use AI features, the service may process prompts, instructions, uploaded files, images, generated content, code and related information required to deliver the requested feature.
Technical and usage information
Depending on the features and infrastructure used, this may include IP address, browser and device information, timestamps, diagnostic records, security logs, usage events and error reports.
Communications
If you contact us for support or other enquiries, we may process the details and correspondence you provide.
Please do not send payment card details, passwords or other highly sensitive information in prompts or support messages unless a specifically designated and secure feature requires it.
9. How we use information
Depending on the circumstances, we may process information to:
- Create, authenticate and maintain accounts.
- Provide AI generation, workspace, file and other requested features.
- Maintain service reliability, troubleshoot faults and improve performance.
- Protect users, investigate abuse and safeguard infrastructure.
- Respond to support requests and communicate important service changes.
- Administer subscriptions and comply with applicable legal obligations.
We rely on an appropriate legal basis for each processing activity, such as performing a contract, pursuing legitimate interests, complying with legal obligations or obtaining consent where required.
Where consent is the legal basis, you may withdraw it at any time. Withdrawal does not affect processing that took place lawfully before it was withdrawn.
10. Storage, infrastructure & sharing
Infrastructure
FAIGEN is developed around the sCloud ecosystem and its sovereign infrastructure ambitions. Depending on the specific feature and deployment, processing may involve sCloud systems, sC01 infrastructure and other systems needed to provide the service.
The location of a particular server does not, by itself, establish where every item of data is processed or stored. Data locations and transfers depend on the systems and services actually used.
Service providers
We may disclose limited information to authorised hosting, infrastructure, security, communications or other service providers where necessary to operate FAIGEN. Where required, appropriate contractual and data protection safeguards apply.
Legal and security disclosures
We may disclose information where required by law or where reasonably necessary to establish, exercise or defend legal claims, investigate serious misuse or protect the rights and safety of users and others.
AI processing
Prompts and files may be processed by the AI engine or supporting services used by the particular feature. Whether processing is local, whether any external provider receives data, and whether information is retained depend on the actual implementation. We will not treat those technical details as guaranteed solely because a service is described as sovereign.
We do not sell personal data as a business model. This statement does not prevent disclosures necessary to provide the service, meet legal requirements or protect the service, as described above.
11. Data retention & security
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including service delivery, account administration, security, dispute resolution and legal compliance.
Retention periods vary by data type and feature. Copies may remain in backups, security logs or records that must be preserved for legitimate operational or legal reasons. Where applicable, data is deleted or anonymised when it is no longer required.
We use appropriate technical and organisational measures designed to protect information against unauthorised access, loss, misuse or alteration. No online service or storage system can be guaranteed completely secure.
If a personal data breach occurs, we will take the steps required by applicable law.
12. Your privacy rights
Depending on the circumstances and applicable law, you may have the right to:
- Request access to your personal data.
- Request correction of inaccurate or incomplete information.
- Request erasure of personal data.
- Request restriction of processing.
- Object to certain processing, including processing based on legitimate interests.
- Receive certain information in a portable format.
- Withdraw consent where processing relies on consent.
- Complain to the Information Commissioner's Office (ICO) in the UK.
These rights are not absolute and may be subject to legal exceptions. We may need to verify your identity before responding to a request.
You can find information about the UK regulator at ico.org.uk.
13. Cookies & similar technologies
FAIGEN may use essential cookies or similar technologies to support login sessions, authentication, security and core functionality.
If non-essential analytics, advertising or tracking technologies are introduced, we will provide the information and consent controls required by applicable law.
Your browser may allow you to manage or block cookies. Blocking essential cookies may prevent some features from working correctly.
14. Changes to these policies
We may update these terms and this policy to reflect changes to FAIGEN, its infrastructure, legal requirements or operational practices. The effective date at the top indicates the version currently published on this page.
Where legally required, we will provide notice of material changes or obtain consent. Continued use of FAIGEN does not override any consent requirement imposed by law.
15. Applicable law
These terms are intended to operate consistently with the laws applicable to the service and the rights of its users. Where permitted, disputes will be subject to the courts with appropriate jurisdiction under applicable law.
Nothing in this section deprives consumers of mandatory protections or courts available to them under applicable law.
